A bill that would automatically legalize a psychedelic medication in South Dakota once it’s approved at the federal level is moving forward in Pierre. The Senate Health and Human Services Committee advanced House Bill 1099 on a 6‑0 vote, with no opposition testimony. The bill would allow the medical use of crystalline polymorph psilocybin—a synthesized form of the psychedelic compound—if the FDA approves it and the DEA reschedules it. Recreational use would remain illegal.
Supporters say the measure would give patients faster access to new treatments for conditions like treatment‑resistant depression and PTSD. Veterans’ groups testified that psychedelic therapies show promise for combat veterans at high risk of suicide.
Drugmaker Compass Pathways told lawmakers that clinical trials have shown significant reductions in depressive symptoms. Senators say they’re encouraged by the potential benefits.
The bill now heads to the full Senate.
