PIERRE, S.D. – South Dakota Attorney General Marty Jackley is applauding a federal appeals court decision that rejected an effort by suspected members of the Tren de Aragua gang to avoid deportation.
Jackley says the Fifth Circuit Court of Appeals made the right decision in dismissing the appeal, calling it an important step in keeping violent offenders out of the United States.
In a statement, Jackley said the president has the authority to remove individuals who pose a threat to public safety, and he says the court’s ruling affirms that authority.
Jackley joined a coalition of 24 state attorneys general that argued the president’s power to remove certain non-citizens under the Alien Enemies Act falls within the executive branch’s national security responsibilities.
