PIERRE, S.D. – Two Pierre residents are facing federal charges after prosecutors say they continued collecting Social Security disability benefits for a deceased recipient.
According to a federal indictment, 51-year-old Beth Miley, also known as Beth French, and 54-year-old Jason Miley, also known as Jake Miley, are charged with conspiracy to defraud the United States, conspiracy to commit bank fraud, and bank fraud. Beth Miley also faces additional charges of theft of government funds and Social Security fraud.
Prosecutors allege Beth Miley failed to notify the Social Security Administration after her husband’s death in February 2023, allowing disability payments to continue. Authorities further claim that between January 2024 and May 2026, the pair made monthly withdrawals from an account receiving those benefits, despite neither being the account owner.
Both defendants pleaded not guilty during a federal court appearance on October 15th and were released on bond. Their trial is currently scheduled for December 15th.
If convicted, the charges carry potential penalties of up to 30 years in federal prison, substantial fines, and restitution. The case was investigated by the Social Security Administration’s Office of Inspector General.
Federal prosecutors emphasize that the charges are allegations and that both defendants are presumed innocent unless proven guilty in court.
